TERMS & CONDITIONS

COPYRIGHT. It is expressly agreed that all rights to use and ownership, including copyright of negatives, digitally or electronically produced images, or any material produced by the Photographer and any reproductions there from are reserved by Photographer for Photographer’s benefit, whether for display, publicity or otherwise.  By default, the Client is granted a non-exclusive rights-managed license for personal use as outlined below.

PERSONAL USE. The Client understands that the customer-provided images are licensed for personal use only. The Client may print their un-watermarked images, and can post to the Client’s own personal Facebook, Twitter, or Instagram or other Social Networking sites only. Customer-provided images may not used for commercial print or reproduction, all external interest in commercial reproduction or rights management must contact Stephanie Lauren Photography directly.  In the event of non-payment, the client relinquishes all usage rights and must discontinue use immediately.

STOCK, MICRO-STOCK, COMMERCIAL USE.  Usage agreements for photographic or other digital and print media must be negotiated on a per-use basis.  Rights-Managed and Royalty-Free license agreements are available upon customer request.  Please contact Stephanie Lauren Photography for further information.

DANGEROUS CONDITIONS. If during the event, the Photographer(s) or their crew are exposed to: (a) Conditions which imperil or cause the photographer(s) and their crew to fear for their safety or (b) Objectionable or illegal actions which the photographer(s) and their crew do not wish to be a part of or to witness;  the Photographer reserves the right to protect their and their crew’s interests including but not limited to a cessation of the event, leaving the event location(s), and/or termination of any agreement.

LIMITATIONS OF VENUE & OFFICIALS. The photographer may be necessarily limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. Client understands and agrees that Photographer(s) will abide by such guidelines or rules, and that they are outside the control of the Photographer(s). The Client agrees to hold the Photographer(s) harmless for the impact such guidelines or rules may have on the resulting photograph.

SPECIFIC IMAGES. The Client and The Photographer agree that the Photographer cannot be held responsible for any specific image that may not be delivered. Many images are captured during the event. Afterward, each image is put through a careful selection process. You will see only the images that meet the quality standards of the photographer. There will be a mix of images that are color, and black & white based on the photographer’s artistic standard. Images with eyes closed, unflattering poses and duplicate images are removed permanently after the photographer completes this selection process. The selection process is entirely the right of the photographer and part of a custom photography process. The Client acknowledges that any failure by the Photographer to deliver a specific image may not be a breach of this Agreement, and shall not result in a refund of any money paid by the Client to the Photographer, and the Photographer shall not provide any other remedy to the Client. The Photographer will work their best to capture every shot that is important to the Client. 

ARTISTIC STYLE. All final print images receive a basic retouching. If it is permanent, such as a birthmark or scar we will not retouch or remove it unless we are specifically asked in writing at the time of contract. This is advanced retouching and may incur an additional fee per image. After images are delivered to the client they can also request certain retouching to images at an additional cost.  

ILLNESS & INJURY. In the unlikely event that Photographer is unable to provide coverage, Photographer will make best efforts to secure the services of an alternate qualified photographer; however the liability of Photographer in any event shall be limited to a credit of equivalent photography services at an alternate date.

CLIENT COOPERATION. Where the Photographer cannot perform proper coverage without the cooperation of the Client, the Client and the Photographer agree to positive cooperation and communication for the best possible result within the definition of this Event. The Photographer is not responsible for key individuals (i.e. wedding party, photo subjects) failure to meet the standard represented by the Photographer in its portfolio examples.

DIGITAL PHOTO RETENTION.  The Photographer makes best reasonable effort to digitally store copies of images delivered on locally redundant storage for a period of no longer than 12 months after the event date.  High-resolution processed images delivered to the Client are considered final works and print-ready.  Digital manipulation and enhanced retouching is available for an additional fee.
